Terms.

These terms are between you and Marzipan Labs LLC, a limited liability company registered in the State of Wyoming, United States (“Marzipan Labs”, “we”, “us”). They govern your use of this website and set the general terms on which we license what we produce.

Individual products publish their own terms. Where they exist, those govern that product, together with the terms of any platform through which you obtained it.

You may read, quote and link to this site. You may not misrepresent it as your own, copy it wholesale, or use automated means to place a load on it that a person reading it would not. The site is published for information about the company and carries no offer, warranty or commitment.

Where you obtain software from us, you receive a personal, non-exclusive, non-transferable, revocable licence to use it on devices you own or control, for your own purposes. It is licensed, not sold.

The licence does not permit you to resell, rent or sublicense it; to decompile, reverse engineer or attempt to derive its source, except so far as applicable law expressly permits; to remove or alter any notice of ownership; or to use it to build a competing product.

What you create using our software is yours. We claim no ownership of it and take no licence to it beyond what running the feature you asked for requires. How it is handled is set out in our Privacy Policy.

You agree not to use our software or services to:

• break the law, or help anyone else do so;
• produce or distribute material that harms or exploits another person;
• interfere with, overload, probe or circumvent our systems, our rate limits, or the mechanisms that establish whether a client is genuine;
• infringe someone else’s intellectual property or privacy, or present output as having come from someone it did not.

We may suspend access where it is necessary to protect our services, other people using them, or to comply with the law.

Some features produce results using statistical models. Such output can be wrong, incomplete or misleading, and it is provided for your judgement rather than in place of it. It is not professional advice of any kind — medical, nutritional, legal, financial or otherwise. Where a product presents an estimate, treat it as an estimate. You remain responsible for the decisions you take and for checking anything that matters.

Where our software is paid for, the purchase is handled by the platform you buy through under its own terms, including its refund policy. We never see or store your payment details. If you believe something has gone wrong, write to us anyway — we can often help, and where the fault is ours we will say so on your behalf.

We improve our software continuously, which means features may change, be added or be withdrawn, and a product may be discontinued. Where that affects something you have paid for, we will give reasonable notice and will not charge for a period we do not intend to serve. Our services depend on third parties and are not guaranteed to be uninterrupted or error-free.

Our software, this website, and everything in them — code, text, design, and the Marzipan Labs name and marks — remain our property or that of our licensors. Nothing here transfers any of it to you. Other product names mentioned anywhere on this site belong to their respective owners.

To the fullest extent permitted by law, our software and this website are provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties; there this section applies only so far as the law permits, and your statutory consumer rights are unaffected.

To the fullest extent permitted by law, Marzipan Labs will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to a product is limited to the greater of what you paid us for that product in the twelve months preceding the claim, or fifty United States dollars. Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of your country of residence, or of the right to bring proceedings there.
